Boston Drug Crimes

Boston drug crimes require an aggressive defense and an attorney that understand what the Commonwealth needs to prove a drug charge against you.   • 4th Amendment Constitutional Defenses to drug cases

In any time of drug case, the first element that the Commonwealth has to prove is possession. If you are charged with simple possession of narcotics, this is the only element, but possession is also an essential element to any charge of drug possession with the intent to distribute or drug trafficking.

A charge of drug possession requires the Commonwealth to prove that you possessed a drug, typically either marijuana, cocaine, heroin, and that you possessed it. Under Massachusetts law, the Massachusetts Supreme Judicial Court has defined possession as the ability to exercise dominion and control over something.

  • Drug possession with the intent to distribute: client was charged with possession with the intent to distribute. Attorney DelSignore obtained a not guilty verdict after a bench trial by arguing that the defendant was merely present at a location where narcotics were kept and had no knowledge or ability to control the drugs.
  • Drug possession: Attorney DelSignore won a case charging the defendant with possession of cocaine by arguing that the police did not have a basis to order the defendant out of the car and search the car without a warrant. The motion was allowed and the case dismissed.
